KEY WEST, Fla. (WSVN) — Jose "Pepe" Diaz’s defense team was denied an acquittal by a judge, Wednesday.
Diaz’s lawyers said their client was slightly impaired and did not deserve the DUI charge.
The State played three videos to the jury of Diaz, including dash cam video of his failed field sobriety test.
The jury was reminded that Diaz declined a breathalyzer test twice. When asked by a lawyer if Diaz had a slight slur, the police officer who pulled him over answered, "Yes."
Key West police pulled him over on his Harley-Davidson for driving 74 mph on South Roosevelt Boulevard, where the speed zone is 35 mph. Diaz was in the Keys for the Key West Poker Run motorcycle weekend.
Two witnesses were called up to the stand by Diaz’s lawyers, both friends who said if they knew he was drunk, they’d pick him up.
The State has, reportedly, rested its case.
