WEST MIAMI-DADE, FLA. (WSVN) - A South Florida man accused of being a problem passenger on board a transit bus faced a judge, Friday.

According to police, that man attacked a passenger and used homophobic slurs, Thursday, while he was on a transit bus in Miami.

Fifty-five-year-old Jose Baños went before a judge Friday morning. “Charged with battery, first-degree misdemeanor,” said the judge.

A representative with the police department spoke about the incident. “The defendant yelled out, ‘The [expletive] gods are going to get you,’ and he essentially began choking the victim.”

A police report stated that “the defendant turned around, scratched him, then bit his left nipple.”

Baños was arrested and charged with battery.

He remains in jail as of Friday on a $1,500 bond.
