MIAMI (WSVN) - One day after a baby was found on the side of the road with her mother, police said, incoherent inside a car that was involved in a crash, the father of the child has been granted temporary custody.

A judge at the New Miami Children’s Courthouse decided Tuesday that the 2-month-old’s biological father should be her caretaker.

Baby Elizabeth’s mother, Magdalne Tricoche, appears to have severe drug issues, as well as a rap sheet that includes prostitution and theft. The baby was wrapped in a blanket and was held by a worker from the Department of Children and Families, during the hearing.

Tricoche was in court where it was revealed that she had cocaine and other opiates in her system.

On Monday, Tricoche and another man, who is not Elizabeth’s father, were involved in a crash in Miami. According to Miami Fire Rescue, they arrived to find both adults unconscious, and the baby was outside of the vehicle in a car seat. “The two adults, male and female, were transported to the hospital,” said Miami Fire Rescue Capt. Ignatius Carroll.

The judge agreed on Tuesday to give the baby’s father, Wayne Alonzo, temporary custody.

Alonzo didn’t particularly want to speak with the press, but when asked about Tricoche, he said, “I don’t know nothing.”

As she walked out of court Tricoche said that she is relieved that her child will be with family. “I’m very happy that she’s going with her father, and that’s all I can tell you,” she said.

Miami Police said they are still investigating the case, and Tricoche could face child neglect or endangerment charges. The man she was with at the time of the car crash could also face charges.

Tricoche has agreed to enter a drug program.
